Terms of service

The agreement between you and AYLAAA when you use this website or instruct us to act for you.

1. Who these terms are between

This website is operated by AYLAAA Residential. By browsing it, enquiring through it, or instructing us on a property, you accept these terms. If you are agreeing on behalf of a company, you confirm you are allowed to do so.

2. Using the site

You may use the site to look for property and to contact us. You may not scrape the listings, copy the photography, or use anything here to build a competing service. We may change or withdraw any part of the site without notice.

3. Property information

Residence details are supplied by sellers and checked by us, but they are a guide, not a survey. Measurements are approximate, photographs show a moment in time, and nothing on this site forms part of a contract. Verify anything that matters to your decision before you commit.

4. Our relationship with you

We act for the seller unless we have agreed in writing to act for you as a buyer. We will be straight with you either way, but we cannot advise both sides of the same transaction.

5. Fees

Our fee, how it is calculated and when it falls due are set out in the agency agreement you sign. Nothing is payable unless a sale completes, unless that agreement says otherwise in terms you have accepted.

6. Ending the agreement

An agency agreement runs for ninety days from signature. Either side may end it earlier in writing with fourteen days' notice. If a buyer we introduced completes within six months of the agreement ending, our fee is still due.

7. What belongs to whom

The design, text, photography and code of this site belong to AYLAAA or to the people we licensed them from. Property photography stays ours after a sale. You keep everything you send us about your own property.

8. Liability

We are responsible for loss we cause by failing to take reasonable care. We are not responsible for a fall in property values, for the acts of a buyer, seller, surveyor or lender, or for loss you could have avoided by checking something we told you to check. Nothing here limits liability for fraud or for death or injury caused by negligence.

9. Complaints

Write to us first. If we have not resolved it within eight weeks you may take it to the property ombudsman scheme we belong to, at no cost to you.

10. Governing law

These terms are governed by the law of the state in which the property sits, and the courts of that state have jurisdiction. If any part of these terms is unenforceable, the rest continues to apply.

11. Changes

We may update these terms. The version published here when you instruct us is the version that governs that instruction, and we will tell you directly about any change that affects an agreement already running.
